A new era has begun at airports... Those who do not comply will not be allowed on the plane

With the law that came into effect today, passengers will not be allowed into the airport or onto the aircraft if they refuse to accept a manual search of themselves and their belongings in the event that the inspections conducted with technical devices at the airport cannot be concluded.

With the enactment of the Law on Amendments to the Turkish Civil Aviation Law and Some Laws and Decree No. 655, which includes regulations in the field of transportation, published in the Official Gazette today:

Accordingly, within the scope of the amendments made to the Ports Law, the Ministry of Transport and Infrastructure will be authorized to determine and supervise the minimum and maximum fees for services provided to ships at ports, piers, and coastal structures, limited to promoting maritime and inland waterway transportation and ensuring a free, fair, and sustainable competitive environment, unless otherwise stipulated by special laws and decrees.

The Ministry will determine the piloting and tugboat services in maritime jurisdiction areas, waterways, and inland waters, as well as the anchoring fees and procedures for payment and exemptions for ships anchoring within port administrative boundaries, unless otherwise stipulated by special laws and decrees.

The anchoring fee tariff, determined by the Ministry, will not exceed 2 lira per gross ton of the ship, taking into account factors such as the ship's voyage, anchoring duration, lump-sum monthly or yearly payment, anchoring reason, and anchoring location. This amount will be increased annually by the revaluation rate as of the beginning of the calendar year. The President will be authorized to increase this amount up to ten times.

Piloting and Tugboat Services

Piloting and tugboat services provided in Turkey's maritime jurisdiction areas, waterways, and inland waters will be conducted by the Ministry of Transport and Infrastructure. The Ministry can delegate or outsource these services to real or legal persons in accordance with the determined procedures and principles.

Those providing piloting and tugboat services will not be allowed to operate in the relevant area if they fail to meet or lose the conditions set by the Ministry or fail to meet the conditions within the given time frame. Those acting contrary to the determined obligations will be fined administrative penalties ranging from 100,000 to 2,000,000 lira by the Ministry or port authority, depending on the nature of the violation.

A "greenhouse gas emission" fee will be collected from ships

A fee will be collected from commercial ships arriving at or departing from ports for handling cargo or passengers, based on their greenhouse gas emissions. These fees will be determined based on verified greenhouse gas emissions and the current carbon price in the European Union Emission Trading System, and the total fee for the previous year will be paid by the end of September of the following year.

The amounts will be recorded as special appropriations in the budget of the Ministry of Transport and Infrastructure to support research, development, conversion, and new construction activities for green shipping.

National Civil Aviation Security Board and aviation security

With the regulation made to the provision of the Turkish Civil Aviation Law on the National Civil Aviation Security Board and aviation security, all passengers will be subjected to technical device inspections and manual searches of themselves and their belongings when passing through airports and onto aircraft to prevent aviation security violations.

If inspections conducted with technical devices cannot be concluded, the passenger in question will not be allowed into the airport or onto the aircraft if they refuse a manual search of themselves and their belongings.

Aviation security measures will be carried out by private security personnel under the supervision of the general law enforcement to ensure the safety of life and property and to prevent unlawful acts against aircraft, aviation facilities, and individuals.

Administrative fines in civil aviation increased

Administrative fines to be applied for non-compliance with authority and obligations in civil aviation have been increased.

The fine for commercial air operators not obtaining permission or operating licenses from the Ministry of Transport and Infrastructure, not reporting tariff changes, not registering Turkish civil aircraft, civil aviation personnel not obtaining competency certificates, pilots not informing the authorities about crimes committed on the aircraft to ensure legal measures are taken, will be increased from 1,000 to 10,000 lira to 20,000 to 500,000 lira; the fine for non-compliance with civil aircraft registration and related procedures will be increased from 500 to 10,000 lira to 10,000 to 500,000 lira.

The fine for non-compliance with the measures to be taken by the Directorate General of Civil Aviation to regulate civil aviation will be increased from 10,000 to 500,000 lira.

A 60,000 lira administrative fine will be applied by the highest local administrative authority to individuals operating unmanned aerial vehicles without obtaining flight permission and outside the areas determined by the Directorate General of Civil Aviation or local administrative authorities, as identified by the general law enforcement authorities.
