ABD Temyiz Mahkemesi, Türkiye'nin Guennol Yıldız Avcısı adlı kadın heykelin 1990'larda topraklarından haksız yere çıkarılmış olabileceğini "bilmesi için nedenleri olduğunu" söyledi. Türkiye'nin, müzayede evinin satmak için listelediği Nisan 2017'ye kadar idolün sahibi Christie ve Steinhardt'a dava açmayı beklediğini ekledi. Mahkeme yargıcı, "Türkiye, kendi Kültür Bakanlığı'ndan heykelin New York'ta olduğuna dair işaretler almasına rağmen kararsız kaldı" diyerek Türkiye'nin iddiasını 2017 yılına kadar getirmemesini, hatta soruşturmamasını mantıksız buldu. Türkiye'nin avukatı Lawrence Kaye, duruşmada Türkiye'nin idolün sahibi olduğunu ve haklarını savunurken "gayretli" olduğunu belirterek, ülkenin sonraki adımlarını düşünerek hareket ettiğini söyledi. Kaye, bu kararın, Türkiye'yi kendisinden çalınan kültürel varlıkları geri istemekten caydırmayacağını aktardı. MAHKEME "ESER GİZLENMEDİ" DEDİ Türkiye, heykelin ülkeye ait olduğu iddiasını 1906'da yayınlanan bir Osmanlı kararnamesine dayandırıyor. Türkiye'nin savunmasında, nerede olduğu bilinmeyen geniş antik eser koleksiyonundaki her parçanın araştırılmasının mümkün olmadığı belirtildi. Savunmada Christie's Müzayede Evi'nin heykelin kaynağını açıkladığı müzayede kataloğuna kadar durumun farkında olunmadığı, bunun da gerekli olmadığı tezi savunuldu. Mahkeme, heykelin New York Metropolitan Sanat Müzesi'nde 30 yılı aşkın bir süredir sergilendiğini ve 1990'lar boyunca Kültür Bakanlığı'nın bu konuda makaleler ve sunumlar yayınladığını söyledi. Mahkeme başkanı, kararında "Stargazer gizlilik içinde tutulmuyordu" dedi. The historical artifact smuggled from Turkey was sold for approximately $14.5 million at an auction held by Christie's Auction House in New York in 2017. Turkey, through the Ministry of Culture, objected to the sale and requested the return of the work. Turkey's lawyer, Lawrence Kaye, stated that Turkey is the owner of the idol and is "zealous" in defending its rights, and said that she acted in consideration of the country's next steps. BUYER CANCELED AT LAST TIME Investor Michael Steinhardt and his wife, the fund billionaire, paid $1.5 million in 1993 for the 22.9 cm tall statue. Christie's auctioned it for $14.5 million, but the buyer backed out.
